Questions and answers

Is it necessary to prove with documents, when declaring a place of residence, that an individual is entitled to declare his or her place of residence at a specific address?
When submitting a place of residence declaration form, the legal basis of an individual to reside at the address indicated in the form must be presented. The individual does not need to present any other document, with the exception of a personal identification document. Additional documents will be needed, if a local government has reasonable doubts about authenticity of data provided and the local government has well-motivated the need of submission of additional documents.

Does an individual have the duty to indicate all addresses of places of residence in his or her place of residence declaration form?
An individual shall declare one address as his or her basic address of place of residence at which he or she can be reached in legal relations with the state and the local government. If an individual wishes so, he or she may indicate unlimited number of additional addresses in his or her place of residence declaration form.

In case, if an individual will give false declaration of his or her place of residence at address of another individual, will he or she be entitled to reside at such declared address?
An individual may declare only such address for place of residence where the individual has the legal basis to reside. Even if an individual has indicated false information in his or her place of residence declaration form, the fact of declaration itself shall not cause civil legal consequences and thus the individual is not entitled to reside at such declared address.

In case, if a local government has started checking the data given in a declaration form, must the data about declared place of residence annulled?
Data about declared place of residence shall be annulled, if a decision has been made on the basis of information obtained during such check that the individual has given false data in his or her place of residence declaration form or the person has no legal basis to reside at his or her declared place of residence.

When declaring place of residence by mail, must a copy of a personal identification document and a copy of a document certifying the legal basis be enclosed to the person’s filled in declaration application?
No, when declaring place of residence by mail, only a place of residence declaration application must be sent to the Office of Citizenship and Migration Affairs.

Must an individual address a local government with a request to annul data about the previous declared place of residence, prior to declaration of new address of place of residence?
No, because when declaring a new place of residence, data about the previous address of individual’s place of residence in the Population Register will be automatically replaced with data about new address of place of residence.

Must place of residence of a minor child be declared at declared place of residence of his or her parents?
No, parents of a child may declare place of residence of the child also at another address.

Must parents of a newborn child declare place of residence of such newborn child, if the parents have verbally indicated place of residence of the child when registering the birth of the child?
In case, if the data about place of residence of the newborn child has not been declared but have been given verbally at registration of the birth of the child and have been included in the Population Register as an indicated address of place of residence, the parents of the newborn child must declare place of residence of the child.

Must an individual address a respective local government and submit a place of residence declaration form after entering into force of the Law on Declaration of Place of Residence (1 July 2003)?
From 1 July 2003, registration address shall be deemed as declared place of residence of a person, until a moment when the individual has declared another place of residence. A place of residence declaration form must be submitted only by an individual who changes his or her place of residence or lives without declared place of residence.
